The terms on which Nexum provides coaching and leadership services, and on which the Leadership Playbook application is made available. Written to be read, not to be hidden behind.

These terms apply between Nexum Coaching, a trading name of ProHealthyx (KvK 88766756), established in Breda, the Netherlands ("Nexum", "we"), and the individual or organisation engaging our services or using our application ("you", "the client").
Where an organisation commissions coaching for an individual, the organisation is the client for commercial purposes, and the individual is the participant. Both are covered by these terms in their respective roles.
The scope, duration and fee of any coaching or programme engagement are agreed in writing before the work begins.
Coaching is a professional, forward-looking partnership aimed at clarity, decision quality and performance under pressure.
Coaching is not therapy, counselling, psychotherapy, medical treatment, or psychological or psychiatric care. It is not a substitute for any of these. Nexum does not diagnose or treat any condition.
Where something falls outside the scope of coaching, we will say so and, where appropriate, suggest that you seek qualified support. You remain responsible for your own decisions, actions and wellbeing at all times.
Nexum holds an International Coaching Federation credential and works to the ICF Code of Ethics.
Everything discussed in a coaching engagement is confidential and is not disclosed without your agreement.
Where an organisation commissions coaching, only information agreed in advance is reported back — for example attendance, progress against agreed objectives, or non-attributable themes across a cohort. Individual session content is never shared.
Confidentiality may be set aside only where disclosure is required by law, or where there is a serious and imminent risk of harm.
How personal data is handled is set out in the Privacy Policy.
We apply this sensibly. Genuine emergencies are treated as such.
Either party may end an engagement early with 30 days' written notice. Sessions already delivered are payable; sessions not yet delivered are not charged.
Because programme dates block capacity that cannot be resold at short notice:
Reasonable non-recoverable travel and accommodation costs already incurred are charged in addition.
All frameworks, models, materials, exercises, slides and written content provided by Nexum remain the intellectual property of Nexum.
You may use them for your own internal development purposes. You may not resell, publish, sublicense, or deliver them as training to third parties without written permission.
Content you create — including reflections written in Leadership Playbook — remains yours.
Leadership Playbook is provided as a self-directed tool, as is, without warranty of uninterrupted or error-free operation.
Where the application is obtained through the Apple App Store or Google Play, that store's own terms apply in addition to these.
Nexum provides professional services with due care and skill. Coaching outcomes depend on many factors outside our control, and no specific result is guaranteed.
To the extent permitted by law, Nexum's total liability arising from an engagement is limited to the fees paid for that engagement in the twelve months preceding the event giving rise to the claim.
Nexum is not liable for indirect or consequential loss, including loss of profit, opportunity, or reputation.
Nothing in these terms excludes liability for intent or deliberate recklessness, or any liability that cannot be excluded under Dutch law.
Where you engage Nexum as a consumer rather than in a business capacity, your statutory rights under Dutch and EU consumer law are unaffected by these terms, including any applicable right of withdrawal for distance contracts.
If something is not right, tell us first — write to info@nexumcoaching.com and we will respond within 14 days and try to resolve it directly.
As an ICF-credentialed practitioner, Nexum is also subject to the ICF's ethical complaint procedure.
These terms are governed by Dutch law. Disputes are submitted to the competent court in the district of Zeeland-West-Brabant, unless mandatory law provides otherwise.
We may update these terms. The version and date at the top of this page will be updated, and the terms in force when an engagement was agreed continue to apply to that engagement.
